Waiver: In consideration of being permitted to participate or use in any way in the use of exercise equipment sold or obtained from EVE company or any equipment sold or obtained from the Math Meets Machine LLC or https://www.eve-company.com/.

"The Activity" use, or any form of use for which, I, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant not to sue Math Meets Machine LLC, or https://www.eve-company.com/ its officers, members, employees, and agents and release all liability from any and all claims including the negligence of use or any activity whatsoever from its officers, members, employees, and agents, resulting in personal injury, accidents or illnesses (including death), and property loss arising from, but not limited to, participation in The Activity.

Assumption of Risks: Participation in The Activity carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, but the risks range from 1) minor injuries such as scratches, bruises, and sprains 2) major injuries such as eye injury or loss of sight, joint or back injuries, heart attacks, and concussions to 3) catastrophic injuries including paralysis and death. I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in The Activity. I hereby assert that my participation or purchase is voluntary and that I knowingly assume all such risks. Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD Math Meets Machine LLC / https://www.eve-company.com/ HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees, brought as a result of my involvement in The Activity and to reimburse them for any such expenses incurred.

Severability: The undersigned, purchase, obtained further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by the law of the State of Delaware and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgment of Understanding: I have read this waiver of liability, assumption of risk, and indemnity agreement, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue.

I acknowledge that purchasing or obtaining any equipment from or designed and made by Math Meets Machine LLC that I am agreeing freely and voluntarily, and intend by my purchase or from obtaining to be a complete and unconditional release of all liability to the greatest extent allowed by law.

The customer is legally responsible for assembly this product with other equipment. The customer is required to use a paint pen or other visible and clear marking on each locknut after reaching the required torque for indicating loosening of the bolted joint.

The customer is legally responsible for maintenance of checking the torque of all hardware before and after use of the equipment and ensuring all hardware is tightened and the equipment is safe for use prior to any person using the equipment. All measurements of torque values will be recorded by the customer in an Excel file format including dates and torque values recorded provided to EVE company at any time when requested.

The customer is legally responsible for replacing any hardware that shows signs of wear. The customer is responsible for replacing locknuts if a bolted joints are disassembled, Locknuts are considered one time use after torqueing.

The customer is legally responsible for safe use of the completed assembly which includes but is not limited to always having a spotter while using the equipment. The customer will always supervise any other person using the assembly. The customer will assume full liability of any person using the equipment.
